ZAJEDNIČKA IZJAVA ČLANOVA KOMISIJĀ „JUSTITIA ET PAX“ BISKUPSKIH KONFERENCIJA BIH, HRVATSKE I SLOVENIJE

Izjava je dostupna na hrvatskom, talijanskom i njemačkom jeziku

Članovi Komisije „Justitia et pax“ Biskupske konferencije Bosne i Hercegovine (BK BiH) okupili su se 6. svibnja 2017. u središtu Banjolučke biskupije na obilježavanju 20. obljetnice osnutka Komisije. Njima su se pridružili i članovi istih komisija Hrvatske i Slovenske biskupske konferencije (HBK i SŠK). Na jubilarnoj sjednici sudjelovao je i poseban gost, kardinal Peter Turkson, dugogodišnji predsjednik Papinskog Vijeća „Justitia et pax“, a sad predsjednik Dikasterija za cjeloviti ljudski razvoj, novoimenovanog tijela Svete Stolice.

Sa svoga zajedničkog zasjedanja sudionici upućuju crkvenoj  i sveopćoj javnost  sljedeću

IZJAVU

U duhu Apostolske Konstitucije Pastor Bonus pape sv. Ivana Pavla II., Komisija „Justitia et pax“ (Pravda i mir) BK BiH nastoji – između ostalog:
·       na području BK BiH promicati pravdu i mir prema načelima Evanđelja i crkvenog društvenog nauka;
·       prikupljati vijesti i rezultate istraživanja o pravdi i miru, o napretku naroda i o povredama ljudskih prava te ih vrednovati i upoznavati javnost sa svojim zaključcima;
·       njegovati odnose s katoličkim udrugama i drugim ustanovama i izvan Katoličke Crkve, koje se iskreno zanimaju za ostvarenje pravde i mira u svijetu;
·       održavati posebne odnose s Papinskim vijećem „Justitia et pax“, odnosno Dikasterijem za cjeloviti ljudski razvoj.

Od svoga osnivanja Komisija je članica Konferencije europskih Komisija „Justitia et pax“.

I. Biskupi Bosne i Hercegovine su i prije osnivanja Komisije „Justitita et pax“ – u duhu Evanđelja i društvenog nauka Katoličke Crkve, dosljedni crkvenim stavovima u vezi s ratom i mirom mnogo puta – zajednički i pojedinačno – apelirali i zauzimali se da do rata ne dođe, da se zaustavi nametnuti rat i da se uspostavi pravedan i trajan mir za sve stanovnike Bosne i Hercegovine. Konstantno su se zauzimali za temeljna ljudska i građanska prava i slobode svih naroda i vjera. Dizali su odlučno svoj glas protiv svih vrsta ratnih i poratnih zločina i nasilja – nad konkretnim čovjekom, neovisno radilo se o  katolicima ili  nekatolicima.

Biskupi su tijekom rata (1992-1995) u svojim brojnim apelima domaćim i međunarodnim političarima jasno davali do znanja „da ne pristaju ni na kakvo mijenjanje granica svojih biskupija, niti na nestanak s tih prostora većeg dijela hrvatskog naroda i Katoličke Crkve, koja mu je inače bila i ostala vjekovima najvjernija roditeljica i zaštitnica“. To su nastavili činiti i nakon rata.

U svojoj izjavi od 29. 1. 1995. biskupi su napisali i ovo:
Duboko smo ožalošćeni zbog nedopustivih propusta međunarodne političke zajednice, koja je pokazala neshvatljivo popuštanje prema agresiji i „sili jačega“, a ravnodušnost prema svom pučanstvu koje trpi neizmjerne nepravde, nasilja, rušenja, progonstva, klanja… Zaprepašteno se pitamo je li moguće da su politički interesi i prestiži beskrajno važniji od čovjeka, od ljudi i naroda, koji se bez ikakve krivnje nalaze pred genocidnim istrebljenjem nakon tolikih stoljeća svoje nacionalne opstojnosti, vjerske prakse ˈkulturne otvorenosti prema svima na ovim prostorimaˈ?“.

U svome pismu Visokom predstavniku Carlosu Westendorpu od 4. 12. 1998. bili su također jasni i dosljedni:
Tražimo ostvarenje prava na siguran povratak i život dostojan čovjeka na vlastitom posjedu i u svom zavičaju, ne samo za pripadnike svoje katoličke zajednice, koji se žele vratiti nego i za pripadnike svake druge vjerske zajednice ili etničke skupine“.

Biskupi BiH su i deset godina nakon rata (29. 10. 2005.) – po tko zna koji put – javno upozorili da Daytonski mirovni sporazum postaje trajan izvor nestabilnosti i ujedno prijetnja miru, te da je najviše štete donio pripadnicima domicilnog hrvatskog naroda odnosno Katoličke Crkve:
Iako su najmalobrojniji i najveće žrtve rata, prognano ih je 67 %, a vratilo se do s ada (2005.) samo 13 %, Hrvati su žrtve i Daytonskog sporazuma, jer kao konstitutivni narod nemaju ni prava manjine. Kao najstariji narod u BiH traže samo da u pravima i dužnostima budu izjednačeni s druga dva naroda u toj zemlji.“

Također i tijekom sljedećih 10–12 godina su biskupi BK BiH u brojnim svojim javnim nastupima kritički, ali dobronamjerno, upozoravali na nametnuti kontrolirani i dozirani kaos u nepravedno uređenoj, nefunkcionalnoj i preskupoj državnoj tvorevini, gdje nije bilo moguće ostvariti ni osigurati potrebni napredak i sigurniju budućnost za sve narode i građane BIH.

Na takav njihov dosljedan i principijelan stav obvezivale su ih smjerodavne riječi pape sv. Ivana Pavla II., izrečene  u Sarajevu 13.4.1997., da su kao biskupi „obvezni upozoravati na nasilja, raskrinkavati nepravde, nazivati zlo pravim imenom i svim zakonitim sredstvima braniti povjerene im zajednice“.

II. U duhu jasnih i dosljednih upozorenja i prokazivanja od strane biskupa BK BiH brojnih nedostataka u temeljnom uređenju države BiH i selektivnosti i nedosljednosti u provođenju Daytonskog mirovnog sporazuma tijekom više od dvadeset poratnih godina, izjašnjavala se i Komisija „Justitia et pax“ te iste BK.

U svojim brojnim izvješćima Komisija je:
·       jasno označavala i obrazlagala uzroke konstantnog stanja obespravljenosti građana i naroda u BiH;
·       predlagala konkretna rješenja;
·       slala apele relevantnim domaćim i međunarodnim političkim čimbenicima za korjenitu promjenu postojećeg nezadovoljavajućeg društveno-političkog stanja u državi;
·       kontinuirano ukazivala da je jedan od glavnih izvora obespravljenosti građana i naroda u BiH nedemokratski, neracionalan i nefunkcionalan ustroj multietničke države BiH, a to su sve gorki plodovi nepravednih rješenja nametnutog Daytonskog mirovnog sporazuma.

Komisija je uvijek iznova u svojim godišnjim izvješćima argumentirano ukazivala da Anex 4 Daytonskog mirovnog sporazuma kao Ustav BiH zapravo nije legitiman, jer njegovi potpisnici nisu demokratski izabrani od strane građana BiH i njenih konstitutivnih naroda. On nije ni legalan s obzirom da kao međunarodni sporazum nije nikad ratificiran u Skupštini BiH niti potvrđen od strane Predsjedništva BiH.

Komisija je višekratno ponavljala općepoznatu činjenicu da je spomenuti Sporazum zaustavio prolijevanje krvi, ali nije donio pravdu i pravednost za sve stanovnike zemlje, nego stalni politički konflikt među domaćim strankama i političarima. Taj konflikt, koji čini državu BiH sve nestabilnijom i besperspektivnijom, ugrožava ujedno i susjedne zemlje.

Komisija je i tijekom zadnjih godina u višekratnim svojim izjavama za javnost, koje je prosljeđivala na adrese svih odgovornih domaćih i međunarodnih dužnosnika, konkretno upozoravala na u praksi sve dramatičniju situaciju – dekonstituiranog domicilnog hrvatskog naroda. Njega sada (22 godine nakon rata) prema crkvenim statističkim podacima nedostaje na području cijele države BiH čak više od 45 % od njegovog predratnog broja. U gotovo polovici države – u entitetu Republika Srpska (RS) – uslijed temeljitog etničkog čišćenja i onemogućavanja održivog povratka prognanog katoličkog pučanstva nedostaje ga više od 90 %.

Tijekom proteklih godina Komisija je često pozivala na dosljednu i striktnu  primjenu Aneksa 7 Daytonskog mirovnog sporazuma da se svim izbjeglim i prognanim osobama stvore uvjeti za siguran i održiv povratak. Općenito je poznato da je kod svih dosadašnjih donatorskih i obnoviteljskih akcija najmanje pomoći dodijeljeno prognanim Hrvatima (3 %!), napose prognanim Hrvatima s područja RS-a, gdje su rezultati njihova održivog povratka poražavajući. Višestruko je isticala da bez održivog povratka u svoja rodna mjesta onih prognanika i izbjeglica, koji se još uvijek žele vratiti, neće biti zadovoljena pravda niti ostvareno pomirenje među ljudima. Rat koji je stotine tisuća naših sugrađana protjerao iz njihovih kuća, uništio im živote i imovinu bio je projekt države ili država. Zato obnova kuća, povratak, stvaranje uvjeta za normalan život isto tako treba biti projekt države ili država. Stoga je Komisija smatrala i smatra kako nitko, u ime bilo kojih ciljeva, nema pravo proglasiti povratak prognanih završenim dok se ne provede Aneks 7 Daytonskog mirovnog sporazuma i dok i prognani Hrvati – katolici ne dobiju iste uvjete – kao i drugi – za svoj održivi povratak.

Osim na bolnu i dramatičnu činjenicu fizičkog iskorjenjivanja domicilnog hrvatskog – katoličkog naroda, Komisija je u više navrata upozoravala službene dužnosnike i cjelokupnu javnost također i na potpuno brisanje njegovih kulturnih, etničkih i političkih identifikacija i nazivlja – od brisanja u matičnim uredima do promjena imena ulica, zatiranja kulturnih društava i vjerskih institucija.

Upozoravala je i na fatalnu nebrigu velikog broja službenih predstavnika Hrvata u zakonodavnoj i izvršnoj vlasti  na razini cijele države, a osobito entiteta RS,  za opstanak hrvatskog naroda u vlastitom zavičaju, te za nužnu materijalnu pomoć onim malobrojnim Hrvatima katolicima, koji su, uz brojne poteškoće, uspjeli ostati u svom rodnom kraju ili su se – uz velike prepreke – uspjeli vratiti odakle su nasilno bili istjerani.

Takvim ponašanjem ti politički predstavnici hrvatskog naroda pristajali su na  legaliziranje nasilnog progona i iskorjenjivanja naroda u velikom dijelu Bosne i Hercegovine, a samim tim  i definitivnog nestanka Katoličke Crkve na tim prostorima.

Komisija je ponavljala riječi biskupā BiH i biskupā Republike Hrvatske (RH) iz 1993. godine, kojima su oni naglašavali kako se ne mogu „pomiriti ni s kakvim političkim rješenjem o budućnosti te napaćene zemlje (BiH), koje bi ozakonilo uništenje više od polovice članova i imovine Katoličke Crkve i hrvatskog naroda u Republici BiH. Time bi se praktički ugasile dvije katoličke biskupije na području Europe“.

Komisija je poticala sve odgovorne u vlasti da odlučnije i zajednički porade na uređenju države uz garanciju svih osnovnih i građanskih prava i sloboda, osobnih i kolektivnih u svim dijelovima zemlje. Upozoravala je da će samo djelomična i kratkoročna rješenja uređenja države nastaviti rađati novim nepravdama i dovesti u pitanje daljnju opstojnost države BiH, ali i domicilnih naroda u nekim njenim sadašnjim dijelovima.

III. Katolička je Crkva u ovim krajevima i u prošlosti i u sadašnjosti  neustrašivo i dosljedno branila čovjekovo dostojanstvo, njegovu bogolikost i  temeljna ljudska prava.

Javnosti je poznato da u ovakvim bosansko-hercegovačkim odnosima domicilni Hrvati i katolici nemaju jednake mogućnosti sudjelovanja u javnom informiranju putem kojega se onemogućava stvaranje istinite predodžbe u bh javnosti o stanju i problemima hrvatskog i katoličkog pučanstva u BiH. Često se u javnosti prikazuje kako svi drugi u zemlji imaju više problema nego Hrvati. Kad se o problemima Hrvata i katolika izvješćuje to se radi na senzacionalistički i neobjektivan način zbog čega se Hrvati sasvim pogrešno percipiraju kao teret Bosne i Hercegovine i u njoj  kao remetilački faktor.

I ovaj put ponavljamo svoj moralni sud – na koji imamo pravo – i kao kršćani i kao građani – da se svim građanima ove naše predugo zgažene – države – pa tako i ovdašnjim katolicima mora omogućiti pravo na izgrađivanje svoje budućnosti, kao što je to slučaj i u svakoj drugoj suvremenoj europskoj prosperitetnoj i funkcionalnoj, pravno uređenoj državi, a što se tijekom svih poratnih godina onemogućavalo.

Također i ovaj put Komisija ponavlja gorku i dramatičnu činjenicu da su katolici u BiH danas fizički najugroženiji dio Katoličke Crkve na cijelom europskom kontinentu.

Svjedoci smo da se nastavlja – pa i povećava neizvjesnost fizičkog opstanka Katoličke Crkve u Bosni i Hercegovini, unatoč neumornom nastojanju vodstva Crkve da u ovoj politički i pravno nesređenoj zemlji bude prijeko potreban čimbenik pravednog i trajnog mira.

Komisija ponovno upozorava da se u BiH nastavlja nepravedna legalizacija zločina počinjenih u ratu 1992. – 1995., kao i politička previranja, sukobi i opća društvena nesigurnost, otežavanje povratka prognanih, onemogućavanje zapošljavanja osobito mnogih mladih ljudi, povećanje nestabilnosti brojnih obitelji, te afektivno i društveno razdvajanje čitavih zajednica.

Komisija i ovaj put potiče sve odgovorne da odlučnije pristupe korjenitim ustavnim promjenama države BiH na načelima federalizma, decentralizacije, supsidijarnosti te legitimnog predstavljanja njegovih konstitutivnih naroda i nacionalnih manjina.

Komisija apelira na službene predstavnike međunarodne zajednice u BiH da pruže učinkovitiju političku, pravnu i materijalnu pomoć za uspostavljanje stvarne ravnopravnosti na području cijele države svih pripadnika triju konstitutivna naroda Bošnjaka, Srba i Hrvata, kao i drugih građana.

Komisija se pridružuje i ovaj put svima onima, koji se trude oko konačnog donošenja Ustava – jednog za cijelu zemlju – umjesto dosadašnja četiri različita ustava.

IV. Bosnu i Hercegovinu, kao „semiprotektorat“ međunarodne zajednice,  ta ista Međunarodna zajednica – nažalost – ostavila je  tijekom svih poratnih godina da bude „prostor nesigurnosti“ umjesto zone mira. Svakom iole humanom čovjeku, a pogotovo političaru, zasigurno je jasno kako održavanje ovakvog „kontroliranog kaosa“ u BiH predstavlja latentnu opasnost ne samo za stabilan mir u ovom dijelu Europe nego i za svjetski mir.

Zato pozdravljamo i podržavamo „Izvješće“ Europskog Parlamenta od 20. veljače 2017. o aktualnoj situaciji u BiH u kojem je izražena spremnost da se državi BiH učinkovitije nego ranijih godina pomogne u okviru procesa stabilizacije i pridruživanja Europskoj Uniji.

Komisija „Justitia et pax“ BK BiH, zajedno s Komisijom HBK i Komisijom SŠK izražava zahvalnost europskim političarima, osobito onima iz Hrvatske i Slovenije, za njihov dragocjeni doprinos u pripremanju i u prihvaćanju ovog  dokumenta međunarodnog karaktera, na temelju kojega će se – nadamo se – moći konačno učinkovitije poraditi oko uređenja BiH kao pravne, sigurne i prosperitetne države za sve njezine stanovnike, etničke i vjerske zajednice, a  osobito obespravljenu katoličku populaciju u njoj.

Zahvalni smo svim našim dobročiniteljima – osobito Svetom Ocu i Svetoj Stolici – za svu dosadašnju dragocjenu brigu i potporu životu i djelovanju Katoličke Crkve u ovoj zemlji, kao i zauzimanju – osobito njenih pastira – za istinu i pravdu, za ravnopravnost, za praštanje, pomirenje i pravedni mir za sve stanovnike Bosne i Hercegovine.

Dichiarazione congiunta
dei membri delle Commissioni „Justitia et pax“
delle Conferenze episcopali di Bosnia-Erzegovina,
della Croazia e della Slovenia

I membri della Commissioni „Justitia et pax” della Conferenza episcopale di Bosnia-Erzegovina (BK BiH), si sono riuniti il 6 maggio 2017 presso la sede della Diocesi di Banja Luka per la ricorrenza del ventesimo anniversario della fondazione della Commissione. Ad essi si sono uniti anche i membri delle medesime Commissioni delle Conferenze episcopali di Croazia e di Slovenia (HBK i SŠK). A questa seduta “giubilare” ha partecipato anche un ospite di eccezione: il cardinale Peter Kodwo Appiah Turkson, da lungo tempo presidente del Pontificio Consiglio „Justitia et pax“ e, attualmente, presidente del Dicastero per il servizio dello sviluppo umano integrale, nuovo organismo della Santa Sede.

Da questa seduta, i partecipanti desiderano far pervenire all’opinione pubblica ed alla Chiesa la seguente

DICHIARAZIONE

Nello spirito della Costituzione apostolica Pastor Bonus del papa san Giovanni Paolo II, la Commissione „Justitia et pax” (giustizia e pace) della BK BiH, si propone – tra l’altro:
·       di promuovere, nel territorio della BK BiH, la giustizia e la pace secondo i principi del Vangelo e della Dottrina sociale della Chiesa;
·       raccogliere le notizie ed i risultati di investigazione sulla giustizia e la pace, sul progresso della popolazione, sulle violazioni dei diritti umani, potenziandoli e mettendo a conoscenza l’opinione pubblica sulle conclusioni;
·       curare i rapporti con le associazioni cattoliche e le altre istituzioni, anche fuori dalla Chiesa cattolica, che sono interessate sinceramente alla realizzazione della giustizia e della pace nel mondo;
·       intrattenere particolari rapporti con il Pontificio Consiglio „Justitia et pax“, o per meglio dire, con il Dicastero per il servizio dello sviluppo umano integrale.

Dal suo esordio, la Commissione è membro della Conferenza delle Commissioni europee di „Justitia et pax“.

I. Prima dell’istituzione della Commissione „Justitia et pax”, i Vescovi della Bosnia-Erzegovina – nello spirito del Vangelo e della dottrina sociale della Chiesa –, coerenti alla posizione della Chiesa circa la guerra e la pace, molte volte – sia singolarmente che congiuntamente – hanno rivolto appelli e si sono impegnati affinché non scoppiasse la guerra, affinché cessasse la guerra imposta, affinché si stabilisse una pace giusta e duratura per tutti gli abitanti della Bosnia-Erzegovina. Costantemente si sono impegnati a favore dei diritti umani e civili, per la libertà di tutti i popoli e per la libertà religiosa. Hanno, decisamente, alzato la voce contro ogni tipo di crimine di guerra e ogni violenza contro l’uomo concreto, indipendentemente, sia esso cattolico o non-cattolico.

Durante la guerra (1992-1995), i Vescovi nei loro numerosi appelli ai politici locali ed internazionali hanno chiaramente fatto capire “di non accettare alcun tipo di modifica dei confini delle proprie diocesi, e neppure la scomparsa, da questi territori, della maggior parte del popolo croato e della Chiesa cattolica che, per loro, è stata per secoli il più fedele genitore e difensore”. Azione che hanno continuato a fare anche dopo la guerra.

Nella loro dichiarazione del 29.1.1995, i Vescovi ha scritto quanto di seguito:
“Siamo profondamente addolorati a causa degli errori intollerabili della comunità politica internazionale che ha mostrato di cedere di fronte all’aggressione e ‘alla forza del più forte’; a causa dell’indifferenza per la propria popolazione che soffre grandissime ingiustizie, violenza, distruzione, esilio e  mattanza… Sbalorditi, ci chiediamo se sia possibile che gli interessi politici e il prestigio siano più importanti dell’uomo, delle persone e dei popoli che, senza alcuna colpa, si trovano di fronte ad uno sterminio genocida dopo tanti secoli della loro esistenza nazionale, delle loro pratiche religiose e “apertura culturale verso tutti in questi territori?”.

Nella loro lettera all’Alto Rappresentante Carlos Westendorp Cabeza del 4.12.1998, i Vescovi sono stati altrettanto chiari e coerenti:

“Chiediamo il diritto ad un ritorno sicuro e ad un dignitoso vivere nel proprio possesso e nel proprio paese, non solo per i membri della Comunità cattolica, che desiderano tornare, ma anche per i membri di qualsiasi altra comunità religiosa o gruppo etnico”.

I Vescovi della BiH, dieci anni dopo la guerra (29.10.2005) – per l’ennesima volta – hanno avvertito pubblicamente che l’Accordo di pace di Dayton diventava fonte continua di instabilità e minaccia alla pace, causando la maggior parte dei danni ai membri del popolo croato locale cioè della Chiesa cattolica:
“Errore di traduzione Anche se è il più piccolo popolo, ma la più grande vittima della guerra – sono stati espulsi il 67% e ritornati, fino ad oggi (2005), solo il 13% –, il popolo croato è vittima anche dell’Accordo di Dayton in quanto, come popolo costitutivo non gode dei diritti della minoranza. In qualità di popolo più antico in BiH chiede solo di essere trattato a parità di diritti e doveri con gli altri popoli in questo paese”.

Inoltre nel corso dei successivi 10-12 anni, i Vescovi della BK BiH, nei loro numerosi interventi pubblici, hanno richiamato l’attenzione, in modo critico e con buone intenzioni, sul caos imposto, controllato e dosato presente nell’ingiusta ma ordinata, inadeguata e costosa creatura statale, nella quale è impossibile creare e assicurare lo sviluppo necessario per un più sicuro futuro per tutti i popoli e gli abitanti della BiH.

In questa loro posizione coerente e di principio li ha vincolati le parole guida di san Giovanni Paolo II, pronunciate a Sarajevo il 13.4.1997, in quanto Vescovi sono “tenuti a denunciare le violenze, a smantellare l’ingiustizia, a chiamare il male con il suo vero nome ed a difendere, con tutti i mezzi legali, le comunità loro affidate”.

II. Nello spirito dei richiami chiari e coerenti da parte dei Vescovi della BK BiH, anche la Commissione „Justitia et pax” della stessa BK si è espressa circa le numerose carenze nella struttura di base dello stato della BiH e circa la selettività e l’incoerenza dell’attuazione dell’Accordo di pace di Dayton, lungo i 20 anni del dopoguerra.

Nei suoi numerosi interventi, la Commissione ha:
·       chiaramente indicato e specificato la cause del costante stato di privazione dei diritti dei cittadini e dei popoli in BiH;
·       proposto delle risoluzioni concrete;
·       inviato appelli a tutti i fattori politici nazionali e internazionali rilevanti per un cambiamento della situazione socio-politica insoddisfacente esistente nel paese;Errore di traduzione
·       continuamente indicato che una delle principali fonti di privazione dei diritti dei cittadini e dei popoli in BiH è  l’organizzazione antidemocratica, irrazionale e disfunzionale dello stato multietnico di BiH che sono tutti frutti amari delle risoluzioni ingiuste dell’Accordo di pace di Dayton.

La Commissione, sempre di nuovo nei suoi rapporti annuali, argomentando ha mostrato che l’Allegato 4 dell’Accordo di pace di Dayton circa la Costituzione di BiH in realtà non è legittimo perché i suoi firmatari non sono stati eletti democraticamente da parte dei cittadini di BiH e dei rispettivi popoli costituenti. Esso non è legale in quanto essendo un Accordo internazionale non è stato mai ratificato nel Parlamento di BiH e neanche confermato da parte della Presidenza di BiH.

La Commissione in diverse occasioni ha ripetuto il fatto generalmente noto che l’Accordo menzionato ha fermato lo spargimento di sangue, ma non ha generato giustizia ed equità per tutti i cittadini del paese, ma un conflitto politico costante tra i soggetti nazionali ed i politici. Questo conflitto rende lo stato di BiH sempre più instabile e senza prospettive, mettendo in pericolo indirettamente anche i paesi limitrofi.

La Commissione, anche negli ultimi anni nelle sue ripetute dichiarazioni al pubblico, che ha inoltrata all’indirizzo di tutti i responsabili nazionali e internazionali pertinenti, concretamente ha messo in guardia circa la pratica di tutta la drammatica situazione del nativo costituito popolo croato.

Secondo i dati statistici della Chiesa, nel territorio di tutto lo stato di BiH, adesso (22 anni dopo la guerra) di questo popolo manca più del 45 % del numero prima della guerra. In più della metà dello stato – nell’entità RS – a causa della pulizia etnica approfondita e dell’impossibilità di un ritorno sostenibile della popolazione cattolica sfollata, manca più del 90%.

Negli ultimi anni, la Commissione ha più volte sollecitato l’applicazione coerente e rigorosa dell’allegato 7 dell’Accordo di pace di Dayton affinché per tutti i rifugiati e gli sfollati si creino le condizioni per un ritorno sicuro e sostenibile. È noto che in tutte le precedenti azioni di donazioni e di ricostruzione l’aiuto minimo è stato assegnato ai profughi croati (3%) soprattutto ai Croati nel territorio della RS, dove i risultati del loro ritorno sostenibile sono devastanti. In molteplici modi abbiamo sottolineato che senza un ritorno sostenibile ai propri posti di lavoro per quei rifugiati e sfollati i quali ancora desiderano tornare, non si realizzerà né una giustizia soddisfacente né una riconciliazione fattiva tra le persone. La guerra, che ha espulso centinaia di migliaia dei nostri concittadini dalle loro case, ha distrutto le loro vite e le proprietà ed è stato un progetto di stato o di stati. Pertanto, la ricostruzione delle case, il ritorno, la creazione di condizioni per una vita normale dovrebbe anche essere un progetto di stato o di stati. Pertanto, la Commissione ha ritenuto e ritiene che nessuno, in nome di un qualsivoglia obiettivo, ha il diritto di dichiarare completato il ritorno degli sfollati finché non si attua l’allegato 7 dell’Accordo di pace di Dayton e finché gli esuli croati-cattolici non ricevono le stesse condizioni – come gli altri – per un loro ritorno sostenibile.

Oltre al fatto doloroso e drammatico dello sradicamento fisico del popolo croato – cattolico locale, la Commissione ha ripetutamente messo in guardia i funzionari ufficiali e il grande pubblico anche circa la totale cancellazione della loro identità culturale, etnica e politica e della terminologia – che va dall’eliminazione negli uffici del Registro di sistema fino al cambiamento delle strade, all’oppressione delle istituzioni culturali e delle istituzioni religiose.

Ha messo in guardia anche contro la negligenza fatale di un gran numero di rappresentanti ufficiali dei croati in seno alle autorità legislative ed esecutive a livello di tutto il paese e, in particolare, dell’entità RS, per la sopravvivenza del popolo croato nella loro stessa patria; ma anche per l’assistenza materiale necessario ai quei pochi cattolici croati i quali, insieme a numerose difficoltà, sono riusciti a rimanere nella loro patria oppure – con grandi difficoltà – sono riusciti a tornare da dove sono stati sfollati con la forza.

Con un tale comportamento questi rappresentanti politici del popolo croato hanno permesso di legalizzare la persecuzione violenta e lo sradicamento della popolazione in gran parte della Bosnia-Erzegovina e, quindi, la scomparsa definitiva della Chiesa cattolica in questi territori.

La Commissione ha ripetuto le parole dei Vescovi di BiH e dei Vescovi di RH del 1993, con le quali hanno sottolineato congiuntamente che non possono “riconciliarsi con nessuna decisione politica sul futuro di questo paese sofferente (BiH), che legalizza la distruzione di più della metà dei membri e delle proprietà della Chiesa Cattolica e del popolo croato nella  Repubblica di BiH. Con questo si spengono praticamente due diocesi cattoliche in Europa”.

La Commissione ha invitato tutti i responsabili del governo a lavorare, con decisione e congiuntamente, sull’assetto del paese con la garanzia di tutti i diritti civili fondamentali, delle libertà individuali e collettive in tutte le zone del paese. Ha avvertito che le soluzioni parziali e a breve termine circa l’assetto dello stato continueranno a produrre solo nuove ingiustizie, mettendo in discussione l’esistenza futura dello Stato di BiH, come anche dei popoli locali in alcune sue parti.

III. La Chiesa cattolica in queste regioni, come nel passato ora nel presente senza paura e costantemente ha difeso la dignità dell’uomo, la sua immagine di Dio e i diritti umani fondamentali.

Al pubblico è ben noto che in queste relazioni bosniaco-erzegovinesi, i croati locali e cattolici non godono di pari opportunità riguardo la partecipazione all’informazione pubblica attraverso la quale si impedisce la creazione di vere e proprie idee nell’opinione pubblica della BiH circa la situazione e i problemi della popolazione croata e cattolica in BiH. Spesso in pubblico si mostra come tutti gli altri, nel paese, hanno più problemi di croati. Quando si espongono i problemi dei croati e dei cattolici, si fa in un modo sensazionalista e non obiettivo per cui i croati, erroneamente, si percepiscono come un peso della BiH ed, in essa, come un fattore di disturbo.

Anche questa volta ripetiamo il proprio giudizio morale – a cui abbiamo diritto sia come cristiani che come cittadini – che a tutti i cittadini del nostro troppo e a lungo schiacciato paese – compresi i cattolici locali – deve essere concesso il diritto di costruire il proprio futuro, come in ogni altro stato europeo, fondato contemporaneo prospero e funzionale; diritto che in tutti gli anni del dopoguerra è stato negato.

Anche questa volta, la Commissione ribadisce l’amara e drammatica constatazione che i cattolici in BiH, oggi, sono fisicamente la parte più vulnerabile della Chiesa cattolica in tutto il continente europeo.

Siamo testimoni che si continua, anzi aumenta, l’incertezza della sopravvivenza fisica della Chiesa cattolica in Bosnia-Erzegovina, nonostante gli sforzi instancabili di governo della Chiesa che, in questo paese disordinato politicamente e giuridicamente, è un fattore indispensabile per una pace giusta e duratura.

La Commissione, ancora una volta, mette in guardia che in BiH si continua a legalizzare i crimini commessi durante la guerra del 1992-1995, così come i disordini politici, i conflitti e l’insicurezza sociale generale; si ostacola il ritorno dei rifugiati; si impedisce l’occupazione soprattutto a tanti giovani; si aumenta l’instabilità di famiglie numerose e la separazione affettiva e sociale di intere comunità.

La Commissione, ancora una volta, incoraggia tutti i responsabili ad approcci risolutamente radicali per una riforma costituzionale di tutta la società bosniaco-erzegovinese riguardante i principi del federalismo, del decentramento, della sussidiarietà e della rappresentazione legittima dei suoi popoli costituenti e delle minoranze nazionali.

La Commissione fa appello ai rappresentanti ufficiali della Comunità internazionale in BiH affinché fornisca un sostegno politico, legale e materiale più efficace per la creazione di una reale uguaglianza di diritti e doveri in tutto il paese tra i membri dei tre popoli costitutivi bosniaci, serbi e croati.

La Commissione concorda, ancora una volta, con tutti coloro che si sforzano per la stesura finale di una Costituzione – unica per l’intero paese – invece delle attuali quattro diverse costituzioni.

IV. Bosnia-Erzegovina, come “semiprotettorato” della Comunità internazionale. Quella stessa Comunità internazionale – purtroppo – l’ha lasciata, durante gli anni del dopoguerra, diventare uno “spazio di incertezza”, piuttosto che una zona di pace. A qualsiasi persona lontanamente umana, in particolare ad un uomo politico, sicuramente è chiaro che il mantenimento di un tale “caos controllato” in BiH rappresenta un pericolo latente non solo per la pace stabile in questa parte dell’Europa, ma anche per la pace nel mondo.

Pertanto va salutato con favore e sostenuto il “Rapporto” del Parlamento europeo del 15 febbraio 2017, sull’attuale situazione in BiH in cui si manifesta la volontà di aiutare lo stato della BiH, in modo più efficace rispetto agli anni precedenti, nel quadro del processo di stabilizzazione e di adeguamento alle strutture europee.

La Commissione “Justitia et Pax” della BK BiH, insieme alla Commissione della HBK e la Commissione della SŠK, esprime la sua gratitudine ai politici europei, in particolare della Croazia e della Slovenia, per il loro prezioso contributo nella preparazione e al voto di questo documento di carattere internazionale, sulla base del quale si potrà – si spera – essere in grado, finalmente, di lavorare, in modo efficace, all’assetto della BiH come un paese legale, sicuro e prospero per tutti i suoi abitanti, le comunità etniche e religiose ed, in particolare, per la popolazione cattolica privata dei diritti civili in esso.
Siamo grati – in particolare al Santo Padre e alla Santa Sede per tutta la cura attuale e preziosa, per il sostegno alla vita e per l’opera della Chiesa cattolica in questo Paese nell’impegno – soprattutto dei suoi pastori – a favore della verità, della giustizia, dell’uguaglianza, per il perdono e la riconciliazione, per una pace giusta per tutti gli abitanti della Bosnia-Erzegovina.

von Mittgliedern der Kommissionen „Justitia et Pax“
der Bischofskonferenz Bosnien und Herzegowina,
der Kroatischen und der Slowenischen Bischofskonferenz

Die Mittglieder der Kommission „Justitia et Pax“ der Bischofskonferenz Bosnien und Herzegowina haben sich am 6. Mai 2017 im Bischöflichen Ordinariat in Banja Luka anlässlich des 20. Jahrestags der Gründung von Kommission versammelt. Ihnen haben sich auch die Mittglieder derselben Kommissionen der Kroatischen und Slowenischen Bischofskonferenz (HBK und SŠK) angeschlossen. Zu dieser Versammlung kam als ausordentlicher Gast Kardinal Peter K. A. Turkson, langjähriger Vorsitzender der Päpstlichen Kommission „Justitia et Pax“ und aktueller Präsident des Dikasteriums für den Dienst zugunsten der ganzheitlichen Entwicklung des Menschen.

Von der Versammlung richteten sie an die kirchliche und weltliche Öffentlichkeit folgende

Erklärung

Die Aufgaben der Kommission „Justitia et Pax“ von Bischofskonferenz Bosnien und Herzegowina (BKBiH), gemäß der Apostolischen Konstitution Pastor Bonus vom Papst hl. Johannes Paul II., unter anderem, sind:
Ÿ auf dem Gebiet von BKBiH Gerechtigkeit und Frieden gemäß dem Evangelium und der Soziallehre der Kirche zu fördern;
Ÿ Nachrichten und Ergebnisse von Forschungen über Gerechtigkeit und Frieden, die Entwicklung der Völker und die Verletzung von Menschenrechten zusammensammeln und -stellen, diese auswerten und die daraus abgeleiteten Schlussfolgerungen der Öffentlichkeit bekannt zu machen;
Ÿ die Beziehungen zu internationalen katholischen Vereinigungen und anderen Einrichtungen zu pflegen, auch zu solchen außerhalb der Kirche, die sich ernsthaft darum bemühen, dass die Werte der Gerechtigkeit und des Friedens in der Welt verwirklicht werden;
Ÿ enge Beziehungen zum Päpstlichen Rat für Gerechtigkeit und Frieden bzw. mit dem Dikasterium für den Dienst zugunsten der ganzheitlichen Entwicklung des Menschen zu pflegen.

Die Kommission „Justitia et Pax“ BKBiH von ihrem Anfang an ist Mitglied der europäischen Kommissionen „Justitia et Pax“.

I. Die Bischöfe von Bosnien und Herzegowina, noch bevor die Kommission „Justitia et Pax“ gegründet wurde, haben sich im Geiste des Evangeliums und der kirchlichen Soziallehre über Krieg und Frieden viele Male, gemeinsam und einzeln um Krieg zu verhindern, dann für das Stoppen des aufgezwungenen Krieges sowie für den gerechten und dauerhaften Frieden für alle Menschen in Bosnien und Herzegowina eingesetzt. Sie setzten sich konsequent und ständig für Grundmenschen- und Bürgerrechte und -freiheiten, für alle Völker und Religionen. Sie erhoben entschieden ihre Stimme gegen jedweder Kriegs- und Nachkriegsverbrechen, gegen jedwede Gewalt am konkreten Menschen, sei es an Katholiken oder Nichtkatholiken.

Die Bischöfe haben während des Krieges (1992–1995) unmissverständlich in ihren Appellen an die einheimischen und internationalen Politiker zur Sprache gebracht, dass sie „keine Grenzveränderungen ihrer Diözesen, kein Verschwinden aus diesem Gebiet des großen Teiles des kroatischen Volkes und der Katholischen Kirche annehmen wollen.

Dem kroatischen Volk war und bliebe die Kirche durch Jahrhunderte Mutter und Fürsprecherin“. Die Bischöfe setzten in diesem Sinne ihre Bemühungen auch nach dem Krieg fort. In ihrer Erklärung von 29.1.1995 schrieben die Bischöfe folgendes:
Wir sind tief betrübt angesichts der unzulässigen Versäumnisse der internationalen politischen Gemeinschaft, die sich in der unverständlichen Nachgiebigkeit gegenüber der Aggression und der “Macht des Stärkeren” und in ihrer Gleichgültigkeit gegenüber einer Bevölkerung, die maßlose Ungerechtigkeiten, Gewaltakte, Zerstörungen, Vertreibungen und Mordtaten über sich ergehen lassen muß, gezeigt haben. Mit den “Stärkeren” verhandelt man auf den Knien liegend, mit den “Schwächeren” in Form von Erpressungen! Entsetzt fragen wir uns, wie es möglich sein kann, daß politische Interessen und politisches Prestige weitaus wichtiger sind als der Mensch, als die Menschen und Völker, die jetzt, nach so vielen Jahrhunderten nationaler Präsenz, der Ausübung ihrer Religion und der kulturellen Aufgeschlossenheit gegenüber allen in den hiesigen Gebieten lebenden Mitmenschen, ohne jegliche Schuld vor der genozidartigen Ausrottung stehen.

In ihrem Brief an den Hohen Vertreter der UN Carlos Westendorp vom 4.12.1998 äußerten sich die Bischöfe klar und konsequent:
„Wir fordern die Verwirklichung des Rechtes auf eine sichere Rückkehr und ein menschenwürdiges Leben auf eigenem Besitz und in eigener Heimat. Das soll gelten sowohl für die Angehörigen unserer katholischen Gemeinschaft, die zurückkehren wollen, als auch für die Angehörigen jeder anderen religiösen oder ethnischen Gruppe“.

Auch zehn Jahre nach dem Krieg haben die Bischöfe von Bosnien und Herzegowina (29.10.2005) abermals erklärt, dass der Friedensvertrag von Dayton stete Quelle der Unsicherheit und gleichzeitig Friedensgefährdung sein wird. Den größten Schaden jedoch brachte er den Angehörigen des einheimischen, kroatischen Volkes bzw. den Mitgliedern der Katholischen Kirche: „Wenn diese zahlenmäßig am kleinsten und als Kriegsopfer am größten sind (67 % von ihnen wurde vertrieben, und zurückgekehrt nur 13 % [Stand 2005]), wurden die Kroaten auch Opfer des Friedensvertrags von Dayton, als konstitutives Volk haben sie nicht einmal Minderheitenrechte. Sie fordern, dass sie als ältestes Volk von Bosnien und Herzegowina in Rechten und Pflichten mit zwei anderen Völkern in diesem Land gleichgestellt werden.“

Die Bischöfe BKBiH haben ebenso in weiteren 10 bis 12 Jahren in zahlreichen öffentlichen Auftritten kritisch aber wohlwollend auf aufgedrängten und gelenkten Chaos im ungerecht aufgebauten, nicht funktionsfähigen und sehr teuren Staatsgebilde aufmerksam gemacht. In so einem Staat kann kein erwünschter Fortschritt und keine gesicherte Zukunft für alle Völker und Bürger verwirklicht werden.

Zu ihrer solchen bestendigen und prinzipiellen Einstellung wurden sie durch die programmatischen Worte des Papstes hl. Johannes Paul II., gesprochen in Sarajevo am 13.4.1997, angewiesen, dass sie als Bischöfe „verpflichtet sind an Gewaltpraktiken aufmerksam zu machen, Ungerechtigkeiten zu enthüllen, Böses mit Namen nennen und mit allen legalen Mitteln ihnen anvertrauten Gemeinschaften in Schutz zu nehmen.“

II. Die Kommission „Justitia et Pax“ von BKBiH hat sich im Laufe von mehr als zwanzig Jahren nach dem Kriegsende stets im Geiste dieser klaren und festen Erklärungen und Aufdeckungen seitens der Bischöfe von BKBiH geäußert, welche die zahlreichen Versäumnisse in der grundlegenden Staatgestaltung von Bosnien und Herzegowina und die unschlüssige Verwirklichung des Friedensvertrags von Dayton gebrandmarkt haben.

In ihren zahlriechen Berichten hat die Kommission:
Ÿ die Ursachen der dauerhaften Ungerechtigkeiten gegenüber den Bürgern und Völkern in Bosnien und Herzegowina benannt und erklärt;
Ÿ konkrete Lösungen vorgeschlagen;
Ÿ Appelle für eine maßgebende Änderung der verstimmten gesellschaftspolitischen Lage im Staat an alle relevanten einheimischen und internationalen politischen Einrichtungen gesandt;
Ÿ beständig darauf aufmerksam gemacht, dass eine der Haupursachen für das Entrechten von Bürgern und Völkern in Bosnien und Herzegowina in undemokratischen, unratsamen und nichtlaufenden Verfassungsform des multiethnischen Staates Bosnien und Herzegowina zu orten ist. All das sind bittere Früchte der ungerechten Folgen des aufgedrängten Friedensvertrags von Dayton.

In ihren Jahresberichten deutete die Kommission immer wieder mit Argumenten darauf hin, dass Annex 4 des Friedensvertrags von Dayton als Teil der Verfassung von Bosnien und Herzegowina im Grunde nicht legitim ist, da seine Unterzeichner nicht demokratisch von den Bürgern Bosnien und Herzegowina und seinen konstitutiven Völkern gewählt wurden. Der Friedensvertrag sei auch nicht legal, da er als internationales Abkommen im Parlament Bosnien und Herzegowina weder ratifiziert, noch seitens des Präsidiums Bosnien und Herzegowina verifiziert wurde.

Die Kommission wiederholte oft allgemein bekannte Tatsache, dass der Friedensvertrag das Blutvergießen aufgehalten, das Recht und Gerechtigkeit den Landbewohnern jedoch nicht gebracht hat. Im Gegenteil, er schürte unter einheimischen Parteien und Politikern dauerhaft politischen Zwietracht. Dieser Zwist macht den Staat Bosnien und Herzegowina instabil und seiner Zukunftsperspektive verlustig, was unmittelbar seine Nachbarstaaten bedroht.

Die Kommission hat während der letzten Jahren in ihren wiederholten öffentlichen Erklärungen, welche sie an die Adresse von allen einheimischen und internationalen Verantwortlichen geleitet und konkret, in der Praxis stets auf die wachsende, dramatische Lage des dekonstituierten einheimischen kroatischen Volkes aufmerksam gemacht hat. Nach den kirchlichen Statistiken fehlen von ihm (jetzt 22 Jahre nach dem Krieg) auf dem ganzen Staatsgebiet Bosnien und Herzegowina mehr als 45 % im Vergleich mit der Vorkriegszeit. In der Entität Republika Srpska, was fast die Hälfte des Staates ausmacht, fehlen aufgrund der ethnischen Säuberung und Verhinderung der nachhaltigen Rückkehr der vertriebenen katholischen Bevölkerung mehr als 90 %.

Während der vergangenen Jahren hat die Kommission oft gefordert zu der konsequenten und strikten Durchführung von Annex 7 des Friedenvertrags von Dayton, dass allen Vertriebenen und Flüchtlingen die Bedingungen angeschafft werden für ihre sichere und verbleibende Rückkehr. Es ist allgemein bekannt, dass bei allen bisherigen donatorischen und wiederaufbaulichen Aktion am wenigsten Hilfe den vertriebenen Kroaten (ca. 3 %!) gegeben wurde, besonders den vertriebenen Kroaten aus dem Gebiet Republik Srpska, wo die Resultate ihrer verbleibenden Rückkehr niederschmetternd sind.

Viele Male hatte die Kommission hervorgehoben, dass ohne verbleibende Rückkehr in die eigenen Geburtsorte jener Vertriebenen und Flüchtlinge, welche noch immer zurückkehren wollen, die Gerechtigkeit nicht befriedigt wird und die Versöhnung unter den Menschen nicht zustande kommen wird.

Der Krieg, welcher hunderte der Tausender unserer Mitbürger aus ihren Häusern vertrieben hat, denen das Leben und Haben vernichtet hat, war ein Projekt des Staates oder der Staaten. Deswegen muss auch der Wiederaufbau der Häuser, Rückkehr, Anschaffung der Bedingungen für ein normales Leben ebenso ein Projekt des Staates oder der Staaten sein. Darum betrachtete und betrachtet die Kommission, dass niemand im Namen irgendwelchen Ziele ein Recht hat, die Rückkehr der Vertriebenen als beendet zu erklären solange Annex 7 von Dayton Friedensvertrag nicht durchgeführt wird und bis auch die vertriebenen Kroaten – Katholiken dieselben Bedingungen für ihre verbleibende Rückkehr – wie anderen – nicht bekommen.

Die Kommission hat mehrmals, außer auf die leidvolle und dramatische physische Entwurzelung des einheimischen, kroatischen – katholischen Volkes, die offiziellen Verantwortlichen und gesamte Weltöffentlichkeit auch auf völliges Auslöschen seiner kulturellen, ethnischen und politischen Eigentümlichkeiten und Terminologie, bis zu Beseitigung in Standesämtern, der Umbenennung von Straßennamen, der Vernichtung von Kulturvereinen und religiösen Institution hin, aufmerksam gemacht.

Sie machte ebenso aufmerksam auf fatales Desinteresse großer Anzahl der offiziellen Vertreter der Kroaten in gesetzgebenden und ausführenden Stellen auf der Staatsebene, vor allem in der Entität Republika Srpska, damit das kroatische Volk in seiner Heimat fortbestehen könnte. Sie erinnerte eindringlich auf die notwendige materielle Hilfe welche die dürftigen katholischen Kroaten benötigen, die zahlreichen Problemen zum Trotz in ihrem Geburtsort geblieben oder gegen allerlei Hindernissen dorthin zurückgekehrt haben, von wo sie mit Gewalt vertrieben wurden.

Diese politischen Vertreter des kroatischen Volkes haben durch solche Handlungsweise die Legalisierung der gewaltsamen Vertreibung und Entwurzelung des Volkes im großen Teil von Bosnien und Herzegowina und damit auch den definitiven Untergang der Katholischen Kirche in diesen Gegenden gutgeheißen.

Die Kommission hat öfters wiederholt die Worte der Bischöfe aus Bosnien und Herzegowina und Kroatien aus dem Jahr 1993, mit weichen die Bischöfe gemeinsam betonten, dass sie sich „mit absolut keiner politischen Zukunftslösung für dieses gequälte Land abfinden können, durch die die Vernichtung von über der Hälfte der Angehörigen Kirche und des kroatischen Volkes in der Republik Bosnien und Herzegowina legalisiert würde. Damit würden im europäischen Ramm praktisch zwei katholische Bistümer und der größte Teil eines Erzbistums ausgelöscht“.

Die Kommission hat alle Verantwortlichen immer wieder angespornt – sich entschlossener und gemeinsam zu bemühen um die Verfassung des Staates mit der Garantie aller Grundmenschenrechte, der Bürgerrechte und Freiheiten, der persönlichen und kollektiven in allen Teilen des Landes. Sie warnte davon, dass nur partiale und kurzfristige Verfassung des Staates mit neuen Ungerechtigkeiten fortgesetzt wird und das weitere Verbleiben des Staates Bosnien und Herzegowina in Frage gestellt wird, aber auch das Verbleiben der einheimischen Völker in manchen seinen jetzigen Teilen.

III. Katholische Kirche in diesen Gegenden hat in der Vergangenheit und in der Gegenwart unerschrocken und konsequent die Würde des Menschen, seine Ebenbildlichkeit und Grundmenschenrechte verteidigt.

Der Öffentlichkeit ist ja bekannt, dass in derartigen bosnisch- herzegowinischen Verhältnissen die einheimischen Kroaten und Katholiken nicht die gleichen Möglichkeiten haben, mitzuwirken im öffentlichen Informationsfeld in der Weise in welcher das Schaffen der wahren Vorstellung unmöglich gemacht wird die über den Zustand und über die Probleme der kroatischen und katholischen Bevölkerung in Bosnien und Herzegowina. Oft wird kundgegeben, dass alle anderen im Lande mehr Probleme haben als Kroaten. Wenn über die Probleme der Kroaten und Katholiken benachrichtigt wird dies auf eine sensationelle und verzerrte Weise gemacht, weswegen die Kroaten ganz falsch perzipiert werden als Last für Bosnien und Herzegowina und als Störfaktor in diesem Land.

Auch diesmal wiederholt die Kommission ihre moralische Beurteilung – auf welche die Mitglieder der Kommission das Recht haben sowohl als Christen als auch Bürger – dass allen Mitbürgern dieses allzu lange zerstampften Staates, und so auch den hiesigen Katholiken, das Rech ermöglicht werden muss auf den Ausbau der eigenen Zukunft, wie dies der Fall in jedem anderem, zeitgenössischem europäischen prosperierten und funktionellen, rechtlich gestaltetem Staat ist, und was während all den Nachkriegsjähren in diesem Land unmöglich gemacht wurde.

Und auch dieses Mal wiederholt die Kommission die bittere und dramatische Tatsache, dass die Katholiken in Bosnien und Herzegowina heute physisch der gefährdetste Teil der Katholischen Kirche auf dem ganzen europäischen Kontinent sind.

Wir sind Zeugen, dass sich fortsetzt – und ja, noch verstärkt die Ungewissheit der physischen Existenz der Katholischen Kirche in Bosnien und Herzegowina, trotz der unermüdlichen Anstrengung der Kirchenführung, dass sie in diesem politisch und rechtlich unstabilen Land der notwendige Stabilisator gerechten und dauerhaften Friedens wird. Die Kommission macht aufmerksam, dass sich in Bosnien und Herzegowina die Legalisierung des Verbrechens getan im Krieg 1992-1995 fortsetzt, ebenso die politische Gärung, Konflikte und allgemeine gesellschaftliche Unsicherheit, erschwert die Rückkehr der Vertriebenen, vereitelt die Beschäftigung besonders bei vielen jungen Menschen, vermehrt die Instabilität zahlreicher Familien und affektive und gesellschaftliche Teilung ganzen Gemeinschaften.

Die Kommission regt auch dieses Mal alle Verantwortlichen auf für die Durchführung der verfassungsrechtlichen Reformen und die Veränderung der ganzen bosnisch-herzegowinischen Gesellschaft auf der Basis des Föderalismus, Dezentralisation und legitimer Vertretung, der Subsidiarität ihren konstitutiven Völker und nationaler Minderheiten.

Die Kommission appelliert auf die Vertreter der internationalen Gemeinschaft in Bosnien und Herzegowina, dass sie effektive politische, rechtliche und materielle Hilfe reichen für das Herstellen echter Gleichberechtigung auf dem Gebiet des ganzen Staates zwischen Angehörigen aller drei konstitutiver Völker Bosniaken, Serben und Kroaten.

Die Kommission schließt sich auch dieses Mal all jenen an die sich bemühen um die endliche Formulierung der endgültigen Verfassung – einer für das ganze Land – anstelle der bisherigen vier verschiedener Verfassungen.

IV. Bosnien und Herzegowina als „Semiprotektorat“ der internationalen Gemeinschaft, lies dieselbe internationale Gemeinschaft – leider – während aller Nachkriegsjahre als Raum der Unsicherheit anstelle der Zone des Friedens. Jedem humanen Menschen, und besonders dem Politiker, ist sicher klar wie das Anhalten dieser „kontrollierten Chaos“ in Bosnien und Herzegowina latente Gefahr stellt, nicht nur für den stabilen Frieden in diesem Teil Europas, sondern auch für den Weltfrieden.

Deshalb ist es zu begrüßen und zu unterstützen den „Bericht“ des Europäischen Parlaments vom 20. Februar 2017 über die aktuelle Lage in Bosnien und Herzegowina, in dem ausgedrückt wurde die Bereitschaft, dass dem Staat Bosnien und Herzegowina wirkungsvoller als in vergangenen Jahren geholfen wird im Rahmen des Prozesses der Stabilisierung und des Anschlusses den europäischen Strukturen.

Die Kommission BK BiH “Justitia et Pax“, gemeinsam mit der Kommission HBK und der Kommission SŠK drücken aus die Dankbarkeit den europäischen Politikern, besonders denen aus Kroatien und Slowenien für ihren unschätzbaren Beitrag in der Vorbereitung und in der Abstimmung dieses internationalen Dokuments, auf welcher Grundlage, – wir hoffen es – endlich wirkungsvoller arbeiten kann auf der Regulierung BiH als des Rechtsstaates, als eines sicheren und prosperierenden Landes für alle ihre Bewohner, ethnische und religiöse Gemeinschaften und besonders für die rechtlose katholische Population in ihm.
Wir sind dankbar allen unseren Wohltäter, besonders dem Heiligen Vater und dem Heiligen Stuhl für alle bisherige kostbare Sorge und Unterstützung des Lebens und das Wirken der Katholischen Kirche in diesem Land und Eintreten – besonders ihrer Hirten – für die Wahrheit, für Gleichberechtigung, für Vergebung, für Versöhnung und gerechten Frieden für alle Bewohner von Bosnien und Herzegowina.

Of the Members of the Commission “Justitia et pax”
Bishops’ Conferences of Bosnia and Herzegovina,
Croatia and Slovenian Bishops’ Conference

Members of the Commission “Justitia et pax” of the Bishop’s conference (BK) BiH gathered on 6th of May 2017. in the center of the Banja Luka’s Diocese to celebrate the 20th anniversary of the establishment of the Commission. The members of the same commissions of the Croatian and Slovenian Bishops’ Conferences (HBK and SŠK) joined them. A special guest also attended the “jubilee” session: Cardinal Peter Turkson, longtime President of the Pontifical Council “Justitia et pax”, and now president of the Dicastery for Promoting Integral Human Development, the newly appointed body of the Holy See.

From their common session, the participants give out to the church and general public the following

STATEMENT

In the spirit of the Apostolic Constitution Pastor Bonus of Pope St. John Paul II, The „Justitia et Pax“ Commission (Justice and Peace) of the BK of BiH strive to – among other:
• Promote justice and peace in the area of ​​the BK of BiH according to the principles of the Evangelical and Church social sciences;
• collect news and results of research on justice and peace, on people’s progress and on human rights violations, and then to evaluate and present to the public the conclusions;
• to cherish the relations with Catholic associations and other institutions, as well as outside the Catholic Church, who are genuinely interested in achieving justice and peace in the world;
• Maintain special relations with the Pontifical Council „Justitia et pax“, that is with the Dicastery for Promoting Integral Human Development.
Since its beginning, the Commission is a member of the Conference of European Commissions „Justitia et pax“.

I. The bishops of Bosnia and Herzegovina, even before the founding of the Commission “Justitita et pax” – in the spirit of the Gospel and the social sciences of the Catholic Church, consistent with the Church’s attitudes regarding war and peace many times – together and individually – appealed and urged that the war should not start, to stop the imposed war and to establish just and lasting peace for all the citizens of Bosnia and Herzegovina. They have always been committed to the fundamental human and civil rights and liberties of all nations and faiths. They raised their voices firmly against all sorts of war and post war crimes and violence – that was done to people not minding if the people were Catholics or non-Catholics.

Bishops, during the war (1992-1995) in their numerous appeals to domestic and international politicians, made it clear that they did not agree to any alteration of the boundaries of their dioceses nor to the disappearance from these territories of mostly Croat people and the Catholic Church, that has always been and stayed for centuries the most loyal parent and patron”. They continued to do so after the war as well.

In their statement from 29 January 1995, the bishops also wrote:
“We are deeply saddened by the unacceptable oversight of the International Political Community, which showed an incomprehensible concession to aggression and „force of strength“, and indifference to the people suffering from unequal injustices, violence, demolitions and slaughter… We are astonished and wondering whether political interests and prestige are more endlessly important than humans, people and nations who are without any guilt being put in front of genocidal extermination after so many centuries of their national survival, religious practice of “cultural openness to all in this region”?

In their letter to High Representative Carlos Westendorp on 4th of December 1998, they were also very clear and consistent:
“We seek realization of the right to a safe return and a life worthy of human in its own property and in its own homeland, not only for members of his Catholic community who wish to return but also for members of every other religious community or ethnic group.”

The bishops of BiH also, ten years after the war (29th of October 2005), yet again, publicly warned that the Dayton Peace Agreement becomes a permanent source of instability and as that a threat to peace, and that it brought most damage to the members of domicile Croatian people, that is the Catholic church:

“Even though they are the least numerous and the largest victims of war, 67% of them have fled, and only 13% of them returned by now (2005), Croats are also victims of the Dayton Agreement, because as the constitutive people they have no rights as minorities as well. As the eldest nation in BiH, they only seek to be equalized in the rights and duties of the two other nations in that country.”

Also during the next 10-12 years, the bishops of BK BiH in their numerous public performances critically but cautiously warned of imposing and controlled chaos in the unfairly organized, dysfunctional and overwhelming state creation, where it was not possible to secure or assure needed progress and a safer future for all nations and citizens of BIH.
To such a consistent and principled attitude, they were obliged by the guiding words of Pope St. John Paul II, said in Sarajevo on April 13th 1997, by which they are as bishops “obliged to warn against violence, to put an end to injustice, to address evil by its proper name and with all legitimate means defend their communities”.

II. In the spirit of clear and consistent warnings and allegations by Bishops of BK BiH of numerous shortcomings in the basic arrangements of the state of BiH and the selectivity and inconsistencies in the implementation of the Dayton Peace Agreement during the period of more than twenty years, the Commission “Justitia et pax” of the same Bishops’ Conference also spoke up.

In its numerous reports, the Commission was:
• Clearly noting and explaining the causes of the constant state of disempowerment of citizens and people in BiH;
• Proposing concrete solutions;
• appealing to all relevant domestic and international political factors for a rooted change in the existing unsatisfactory social and political state in the country;
• continuously pointing out that one of the main sources of disempowerment of citizens and nations in BiH is undemocratic, irrational and dysfunctional organization of the multiethnic state of BiH, which is all the bitter fruit of the unethical solutions imposed by the Dayton Peace Agreement.

The Commission has repeatedly in their annual reports pointed out that Annex 4 of the Dayton Peace Agreement as the Constitution of BiH was not legitimate because its signatories were not democratically elected by the citizens of BiH and its constitutive nations. It is not legitimate considering that as an international agreement it has never been ratified in the Assembly of BiH or endorsed by the Presidency of Bosnia and Herzegovina.

The Commission has repeatedly pointed out to the fact that the said Agreement stopped blood spills but did not bring justice and righteousness to all the people of the country, but a permanent political conflict between domestic parties and politicians. This conflict that makes the state of BiH more and more unstable and non-perspective, is threatening indirectly the neighboring countries as well.

In recent years, the Commission has repeatedly warned in its repeated statements for public which addressed all responsible domestic and international officials in an increasingly dramatic situation – of the deconstructed domicile Croatian people. Nowadays (22 years after the war) according to church statistics, the Croatian people are, in the whole country, more than 45% of its pre-war number gone. In almost half of the country – in the RS entity – due to thorough ethnic cleansing and disabling the sustainable return of the exiled Catholic population, more than 90% never returned.

Over the past years, the Commission has often called for the consistent and strict application of Annex 7 of the Dayton Peace Agreement to create all refugees and displaced persons the conditions for a safe and sustainable return. It is generally known that in all previous donor and rebuilding actions the least aid was given to the Croatians (3%!), especially Croats in the RS area, where the results of their sustainable return are devastating. We have stressed that without sustainable return, of the refugees who are still willing to return, the justice will not be satisfied and the reconciliation between people will not be made. The war, which exiled hundreds of thousands of our fellow citizens from their homes, destroyed their lives and properties, was a country or countries project. Therefore, the restoration of a house, the return, the creation of conditions for normal life should also be the project of a country or countries. Therefore, the Commission considered and still consideres that nobody, in the name of any of their goals, has the right to declare the return of refugees and displaced persons completed until Annex 7 of the Dayton Peace Agreement is implemented and until the exiled Croats – Catholics do not receive the same conditions as the others for their sustainable return.

Apart from the painful and dramatic fact of the physical extermination of the domestic Croat – Catholic people, the Commission has repeatedly warned officials and the general public also of completely erasing of their cultural, ethnic and political identifications and terminology – from deleting them in their home offices to changing street’s names, suppressing cultural societies and religious institutions.

They also warned of the fatal disregard of a large number of Croat’s representatives in the legislative and executive authorities on the level of the entire country, and in particular of the RS entity, for the survival of the Croat people in their own homeland and for the necessary financial assistance to the few Croat Catholics who, even with many problems, managed to stay in their hometowns, or they were, with great obstacles, able to return, where they had been forced out from.

With such behavior, these political representatives of the Croatian people agreed to legalize the violent persecution and extermination of the people in the great part of Bosnia and Herzegovina, and this way the definitive disappearance of the Catholic Church in those areas.

The Commission repeated the words of the Bishops of Bosnia and Herzegovina and the Bishops of the Republic of Croatia from 1993, with which they jointly stressed that they cannot “reconcile with any political solution to the future of the wounded country (BiH), which would lawfully allow destruction of more than half of the members and the properties of the Catholic Church and the Croatian people in the Republic of BiH. This would virtually extinguish two Catholic dioceses in Europe”.

The Commission encouraged all responsible authorities to be more determent and jointly agree on the organization of the country with the guarantee of all basic and civil rights and freedoms, personal and collective in all parts of the country. They warned that partial and short-term solutions of the country’s regulation would continue to create new injustices and not only question the further survival of the state of BiH, but also of the domicile people in some of its current parts.

III. The Catholic Church in these parts, in the past and present, fearlessly and consistently defended man’s dignity, his religion and fundamental human rights.

The public knows that in such Bosnian-Herzegovinian relations, domicile Croats and Catholics do not have the same opportunities to participate in public information that prevents the creation of a true public image of the situation and problems of Croatians and Catholics in BiH. It is commonly shown in the public that everyone else in the country has more problems than Croats. When it is reported of problems of Croats and Catholics, it is done in a sensationalist and non-objective way, which makes perception of Croats misleading, they are seen as the burden of Bosnia and Herzegovina and as a disturbance factor in it.

This time again we repeat our moral judgement – on which we have the right – as Christians and as citizens – that to all citizens of ours for far too long crushed country – and thus the local Catholics must have the right to build their future, just like in every other modern European prosper and functional legalized country, which has been disrupted during all the years after the war.

This time again the Commission repeats the bitter and dramatic fact that Catholics in BiH today are physically the most vulnerable part of the Catholic Church on the entire European continent.

We are witnessing the continuation – even increasement of the uncertainty of the physical survival of the Catholic Church in Bosnia and Herzegovina, despite the tirelessly efforts of the Church’s leadership that in this politically and legally disordered country becomes a truly needed fair and lasting peace factor.

The Commission warns again that in BiH unjust legalization of crimes committed in the 1992-1995 war continues, as well as political turmoil, conflict and general social insecurity, making the return of displaced persons unable, preventing employment, especially among many young people, increasing the instability of numerous families, and affective and social separation of the whole communities.

The Commission yet again encourages all those responsible to step up their approach to rooted constitutional changes of the entire BiH society principled on federalism, decentralization, subsidiarity and legitimate representation of its constitutive people and national minorities.

The Commission calls on the international community representatives in BiH to provide more effective political, legal and material aid for the establishment of real equality across the country among members of the three constitutive people – Bosniaks, Serbs and Croats.

The Commission joins this time again to all those who are struggling to make the final adaptation of the Constitution – one for the whole country – instead of the current four different ones.

IV. Bosnia and Herzegovina, as the „semi protected issue“ of the International Community, that same International Community –has unfortunately left it throughout all the post war years to be a „place of insecurity“ instead of a peace zone. Every human being, and especially a politician, is certainly clear that maintenance of such a „controlled chaos“ in BiH is a latent danger not only for a stable peace in this part of Europe but also for world peace.

Therefore the „Report“ from the Europen Parliament from February 15th 2017., which expresses more willingness to more effectively assist the state of BiH in the process of stabilization and joining with European structures than in previous years is welcomed and supported.

The „Justitia et pax“ Commission of BK BiH, together with the Croatian BK Commission and the Slovenian BK Commission, expresses gratitude to European politicians, especially from Croatia and Slovenia, for their valuable contribution to the preparation and adoption of this document of international character, based on which we hope – will be ultimately more efficient to work on regulating BiH as a legal, safe and prosperous country for all its citizens, ethnic and religious communities, and especially the disenfranchised Catholic population in it.

We are grateful, especially to the Holy Father and to the Holy See for all the valuable care and support for the life and the work of the Catholic Church in this country – in particular its shepherds – for truth, justice, equality, forgiveness, reconciliation and just Peace for all citizens of Bosnia and Herzegovina.
